The main forms of food business are divided into food sales operators, catering service operators, and unit canteens. Food business operators who apply to operate through the Internet, establish a central kitchen, or engage in group meal distribution, shall be marked with brackets after the main business format.


Food business items are divided into pre-packaged food sales (including refrigerated frozen foods, refrigerated frozen foods not included), bulk food sales (including refrigerated frozen foods, refrigerated frozen foods not included), special food sales (health foods, special medical formula foods) , Infant formula milk powder, other infant formula foods), other food sales; manufacture and sale of hot foods, manufacture and sale of cold foods, manufacture and sale of raw foods, manufacture and sale of pastry foods, manufacture and sale of homemade beverages, others Manufacturing and sales of similar foods.


The specific varieties included in the sale of other types of food and the manufacture and sale of other types of food shall be reported to the State Food and Drug Administration for approval and be clearly marked. Foods with various situations such as hot, cold, raw, solid, liquid, etc. , which are difficult to categorize clearly, can be classified according to the situation with the highest food safety risk level.


The State Food and Drug Administration can adjust the categories of food business items according to the needs of supervision and management.



Article 11 The application for food business license shall meet the following conditions:

(1) Having food raw material processing and food processing, sales, storage and other places suitable for the variety and quantity of foods to be managed, keeping the environment of the place clean and tidy, and maintaining a prescribed distance from toxic and harmful places and other pollution sources;


(2) It has business equipment or facilities suitable for the variety and quantity of foods under operation, with corresponding disinfection, dressing, washing, lighting, lighting, ventilation, anti-corrosion, dustproof, fly-proof, rodent-proof, insect-proof, washing and treatment Waste water, equipment or facilities for storing garbage and waste;


(3) There are full-time or part-time food safety management personnel and regulations to ensure food safety;


(4) Having a reasonable equipment layout and process flow to prevent cross-contamination of the food to be processed and directly imported food, raw materials and finished products, and avoid food contact with toxic and unclean materials;


(5) Other conditions stipulated by laws and regulations.



Article 12 To apply for a food business license, the following materials shall be submitted to the local food and drug administration at or above the county level where the applicant is located:

(1) Application for food business license;


(2) A copy of the business license or other subject qualification documents;


(3) The layout of the main equipment and facilities, operation procedures and other documents suitable for the food business;


(4) Food safety self-inspection, health management of employees, purchase inspection records, food safety accident handling and other rules and regulations to ensure food safety.


If the vending equipment is used for food sales, the applicant shall also submit materials such as the product qualification certificate, specific place of placement, name of the operator, residence, contact information, and method of publicizing the food business license.
If the applicant entrusts another person to apply for a food business license, the agent shall submit a power of attorney and the agent ’s identification documents.
